The August 4, 2010 ruling of Chief U.S. District Judge Vaughn Walker which declared California’s Proposition 8 to be unconstitutional, is a battle won for the gay camp in their civil rights war.
Many LGBT’s in New Jersey see this as a key ruling that can be used in the court room where New Jersey’s civil union law will be put on trial. California’s domestic partnership law is similar to New Jersey’s civil union law, which also fails to provide the equal protection that only comes with marriage equality. All eyes are now on California and any possible appeal that may make its way to the U.S. Supreme Court.
